The launch signals a broader shift in how large IP law firms are deploying AI: not through third-party platforms, but through internally developed tools trained on firm-specific institutional knowledge. For clients managing large patent portfolios, the distinction matters because the tool reflects the firm's own legal standards rather than a generic model.
How It Works
FishStream AI targets three core tasks in patent prosecution: office action analysis, Alice rejection support, and application drafting support.
On office actions, the tool identifies claim limitations at issue, summarizes examiner rejections, flags potential weaknesses, and proposes counterarguments or amendment options for attorney review. For Alice rejections, which involve patent eligibility challenges under a specific U.S. Supreme Court framework, it applies the relevant legal test and generates draft responses. On drafting, it organizes inventor materials, summarizes inventions, suggests follow-up questions, and proposes independent claims.
Attorney Oversight Built In
The tool operates on what Fish describes as a "non-negotiable human-in-the-loop" model. Every output serves as a starting point, not a final work product. Attorneys retain control over legal strategy, claim development, and all client-facing materials.
Tracy Hitt, the Fish principal who developed FishStream AI, said the tool "provides a logical starting point built on our institutional knowledge and followed by a non-negotiable human-in-the-loop approach that integrates attorney experience and judgment, with a focus on delivering excellent value to clients."
In complex matters, the platform cross-references claim elements against cited prior art references, surfaces key distinctions, and generates claim charts to support attorney review.
Security and Deployment
FishStream AI runs entirely within Fish's secure enterprise environment. The firm has built strict safeguards around client data, with no reliance on external platforms or third-party AI services for processing sensitive information.
